Texas Medical Records Privacy Policy

Effective Date: May 22, 2026

This Texas Medical Records Privacy Policy supplements the information contained in our Privacy Policy and applies only if you are a resident of Texas and only if the health information we have falls within the scope of the Texas Medical Records Privacy Act (Texas Health and Safety Code §181.001 et seq.).

Your Rights

Under the federal HIPAA Privacy Rule and the Texas Medical Records Privacy Act, you have the following rights regarding your health information:

Access Your Records

You can ask to see or get a copy of your medical record and other health information we maintain. Requests may be in writing at our mailing address shown below or by email at our email address shown below. Texas law requires that we respond within 15 business days of receiving your written request.

Request Corrections

If you believe any information is incomplete or inaccurate, you may request a correction in writing including by email. We may request additional information about you to confirm your identity or that you are an authorized representative.

Request Confidential Communication

You can ask us to contact you in a specific way (for example, via cell phone, text, or email) or at a different address.

Limit What We Use or Share

You can ask us not to use or share certain health information for treatment, payment, or operations. We will accommodate reasonable requests when legally permissible.

Get a List of Disclosures

You may request a list of instances (for the past six years) where your health information was shared, except for treatment, payment, or operational purposes. You may also request a list of third parties (including covered entities and business associates) with whom your protected health information (PHI) was shared electronically.

Receive a Copy of This Notice

You may request a paper copy of this policy at any time, even if you agreed to receive it electronically.

Choose a Representative

If you have given someone medical power of attorney or have a legal guardian, that person can exercise your rights on your behalf.

File a Complaint

If you believe your privacy rights have been violated, you may file a complaint by emailing or writing us as provided below. You can also file a complaint with the Secretary of the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201 or calling 1-800-368-1019, (TTY: 1-866-788-4989) or visiting www.hhs.gov/ocr/privacy/hipaa/complaints. You will not be penalized for filing a complaint.

Your Choices

  • You can tell us your preferences about how we share your information in these situations:
    • Marketing or promotional communications (only with your written permission).
    • Use of photos/videos for social media or advertising (only with your explicit written consent).
    • Appointment reminders, follow-up messages, or post-treatment check-ins (via text, call, or email).

Electronic Disclosure Authorization (Texas Requirement)

Texas law requires written authorization before we electronically disclose your protected health information to anyone other than a health care provider, health care facility, health plan, or other covered entity for the purpose of treatment, payment, health care operations, or certain insurance or HMO functions, or as otherwise authorized by state or federal law.

You will be asked to sign a separate Authorization for Electronic Disclosure form before any such disclosures occur.

Our Uses and Disclosures

We typically use or share your health information in the following ways:

Treatment

We use your information to coordinate and manage your health care and educate you on available benefits and care options.

Example: Scheduling preventive care appointments to address your unaddressed health care needs.

Operations

We use your information to improve our services, to ensure your health care needs have been met, to report results from our services to your health plan, and to contact you when necessary.

Example: Reviewing treatment outcomes to improve safety and quality of care.

Other Uses (As Required by Law)

We may use or share your information when required by law, such as:

  • Public health and safety reporting.
  • Law enforcement or court orders.
  • Serious threats to health or safety.
  • Compliance with Texas Health and Safety Code and other applicable laws.

Our Responsibilities

  • We are required by federal and Texas law to maintain the privacy and security of your health information.
  • We are required by federal and Texas law use commercially reasonable measures to keep your information private and safe.
  • We will notify you and the Texas Attorney General’s Office within 60 days if your information has been breached or accessed improperly, as required by Texas Business and Commerce Code §521.053.
  • We must follow the duties and privacy practices described in this policy and our privacy policy.
  • We will not use or share your information for any reason not described here unless you provide written authorization. You may revoke that authorization at any time in writing.

 

Sensitive or Minor Records

Texas law provides additional confidentiality protections for certain types of records (e.g., reproductive health, mental health, or substance-use treatment). Access to such records may require additional authorization and may be limited even for parents or guardians of minors.
